1. Introduction and Scope

 

These General Terms and Conditions (“Terms”) govern the purchase of sailing courses, liveaboard sail vacations, and related services (“Services”) offered by Red Sky Sailing Barcelona, S.L. (“the Company,” “we,” “us”) through the website redskysailingbarcelona.com.

By making a booking or purchasing any Service, the customer (“you”) agrees to be bound by these Terms. Please read them carefully before completing your reservation.

These Terms comply with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), Spanish Royal Legislative Decree 1/2007 on General Consumer Protection (LGDCU), and applicable European Union consumer protection directives.

 

2. Services Offered

 

Red Sky Sailing Barcelona offers ASA-certified (American Sailing Association) sailing instruction in English, operating from Port Olímpic, Barcelona. Our services include:

 

  • Day courses: ASA 101 (Basic Keelboat), ASA 103 (Basic Coastal Cruising), ASA 104 (Bareboat Cruising)
  • Liveaboard sail vacations: week-long courses aboard 35–46 foot sailboats along the Catalan coast, combining ASA certifications with a Mediterranean sailing experience
  • Catamaran courses: ASA 114 (Cruising Catamaran) aboard a Lagoon 42 or Bali 4.2
  • Private instruction:available on request

 

Specific course details, dates, itineraries, pricing, and availability are published on the website and may be updated from time to time.

 

3. Booking and Payment

 

3.1 Reservation

A booking is confirmed upon receipt of the required deposit payment. Until payment is received, no reservation is guaranteed.

3.2 Deposit

A non-refundable deposit is required at the time of booking to secure your place. The deposit amount is specified on the booking page for each course or sail vacation.

3.3 Balance Payment

The remaining balance is due no later than 30 days before the course start date. If booking is made within 30 days of the course start date, full payment is required at the time of booking.

3.4 Payment Methods

Payments are processed securely via Stripe. We accept major credit and debit cards. All prices are listed in euros (€) and include applicable VAT (IVA) unless otherwise stated.

3.5 Confirmation

Upon successful payment, you will receive an email confirmation with course details, what to bring, and any pre-course requirements.

 

4. Cancellation and Refund Policy

 

4.1 Cancellation by the Customer

 

  • More than 60 days before the course start date: Full refund minus the non-refundable deposit.
  • 30 to 60 days before the course start date: 50% refund of the amount paid (excluding the deposit).
  • Less than 30 days before the course start date: No refund.
  • No-show: No refund.

 

All cancellation requests must be submitted in writing to info@redskysailingbarcelona.com.

4.2 Transfer of Booking

You may transfer your booking to another person at no charge, provided the transfer is communicated in writing at least 14 days before the course start date and the replacement participant meets any applicable prerequisites.

4.3 Cancellation by the Company

We reserve the right to cancel or reschedule a course due to insufficient enrollment, adverse weather conditions, vessel unavailability, or other circumstances beyond our control. In such cases:

 

  • You will be offered an alternative date at no additional cost, or
  • A full refund of all amounts paid, including the deposit.

 

We are not liable for any additional costs incurred by the customer as a result of cancellation (such as travel, accommodation, or other expenses).

 

4.4 Weather Cancellations

Sailing is weather-dependent. If a course day is cancelled due to unsafe weather conditions, the Company will make reasonable efforts to reschedule the missed day. If rescheduling is not possible, a partial refund or credit toward a future course will be offered at the Company’s discretion.

4.5 Right of Withdrawal (EU Consumers)

In accordance with Article 103(l) of Royal Legislative Decree 1/2007, the statutory 14-day right of withdrawal does not apply to services related to leisure activities where the service is to be provided on a specific date or within a specific period. However, if you believe the right of withdrawal applies to your booking, please contact us within 14 days of purchase.

 

5. Customer Obligations

 

5.1 Prerequisites

Certain courses require prior certification (e.g., ASA 114 requires ASA 101). It is the customer’s responsibility to ensure they meet the prerequisites listed on the website before enrolling.

5.2 Health and Fitness

Participants must be in reasonable physical health and able to participate in sailing activities. You must inform us of any medical conditions, disabilities, or physical limitations that may affect your ability to participate safely.

5.3 ASA Registration

Students must register for a free American Sailing ID (ASID) with the American Sailing Association before the course start date. Without an ASID, certification cannot be issued upon course completion.

5.4 Conduct

The captain’s authority aboard the vessel is absolute. Participants must follow all safety instructions. The Company reserves the right to remove any participant whose behavior endangers themselves, other participants, or the vessel, without refund.

5.5 Personal Information

You agree to provide accurate personal information at the time of booking, including a valid home mailing address for ASA certification card delivery.

 

6. Liability

 

6.1 Insurance

The Company maintains appropriate liability insurance for its sailing instruction activities. Participants are strongly encouraged to obtain their own travel and health insurance.

6.2 Assumption of Risk

Sailing involves inherent risks including but not limited to weather, sea conditions, and physical exertion. By booking a course, you acknowledge and accept these risks.

6.3 Limitation of Liability

To the maximum extent permitted by law, the Company’s total liability for any claim arising from or related to the Services shall not exceed the total amount paid by the customer for the specific course or vacation in question.

The Company is not liable for:

 

  • Loss, theft, or damage to personal belongings
  • Delays or changes caused by weather, port authorities, or other circumstances beyond our control
  • Any indirect, consequential, or incidental damages

 

6.4 Waiver

All participants are required to sign a liability waiver before participating in any on-water activity. A digital waiver will be sent upon booking confirmation.

 

7. Certification

 

7.1 ASA Certification

Successful completion of a course does not guarantee certification. Certification is awarded at the instructor’s discretion based on the student’s demonstrated competency in accordance with ASA standards.

7.2 Certificate Delivery

Upon successful completion, your certification is submitted to the American Sailing Association, who will mail your certification card to the home address provided at booking. Delivery times are determined by the American Sailing Association and are outside the Company’s control.

 

8. Intellectual Property

 

All content on the website — including text, images, logos, course materials, and design — is the property of Red Sky Sailing Barcelona, S.L. or its licensors and is protected by Spanish and international intellectual property law. Reproduction, distribution, or modification without written permission is prohibited.

 

9. Data Protection

 

Personal data is processed in accordance with our Privacy Policy, available at redskysailingbarcelona.com/contact/privacy-policy/. By making a booking, you consent to the processing of your data as described in the Privacy Policy.

Your home mailing address and ASID number will be shared with the American Sailing Association (www.americansailing.com) for the purpose of issuing and delivering your certification card, as described in our Privacy Policy.

 

10. Complaints

 

If you are dissatisfied with any aspect of our service, please contact us at info@redskysailingbarcelona.com. We will acknowledge your complaint within 48 hours and endeavor to resolve it promptly.

EU consumers may also submit complaints through the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

 

11. Governing Law and Jurisdiction

 

These Terms are governed by Spanish law. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts and tribunals of Barcelona, Spain, except where mandatory consumer protection legislation provides otherwise. In the case of consumers, the courts of the consumer’s place of residence shall have jurisdiction.

 

12. Modifications

 

The Company reserves the right to modify these Terms at any time. The applicable version is the one published on the website at the time of booking. Material changes will be communicated via the website.
